14. Dispute Resolution
14.1 Informal resolution first
Before filing any formal claim, you agree to contact us at
[email protected] and give us 30 days to attempt to resolve the dispute informally. This requirement does not apply to claims for injunctive or other equitable relief.
14.2 Governing law
These Terms shall be governed and construed in accordance with the laws of the Commonwealth of Massachusetts, United States, without regard to its conflict of law provisions. Any disputes not resolved informally shall be resolved in the state or federal courts located in Suffolk County, Massachusetts, and you consent to the personal jurisdiction of those courts.
14.3 Canadian users
For users accessing Mulyra from Canada, this Agreement is governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any disputes not resolved informally shall be resolved in the courts of Ontario, Canada. Nothing in this clause limits Mulyra's ability to seek injunctive or other equitable relief in any jurisdiction.
14.4 EU users
Nothing in these Terms limits your rights as a consumer under applicable EU law, including your right to bring a claim before the courts of your country of residence or to use any applicable alternative dispute resolution scheme. 14.5 UK users
For users accessing Mulyra from the United Kingdom, this Agreement is governed by the laws of England and Wales. Any disputes not resolved informally shall be resolved in the courts of England and Wales. Nothing in these Terms limits your rights as a consumer under the Consumer Rights Act 2015 or other applicable UK consumer protection legislation. You retain the right to bring a claim before the courts of your habitual residence.
14.6 Israeli users
For users accessing Mulyra from Israel, this Agreement is also subject to the Israel Privacy Protection Law 5741-1981 (as amended) and applicable Israeli consumer protection legislation. Any disputes not resolved informally may be brought before the competent courts of Israel. Nothing in this clause limits Mulyra's ability to seek injunctive or other equitable relief in any jurisdiction, and nothing limits your rights under applicable Israeli law.
14.7 Indian users
For users accessing Mulyra from India, this Agreement is governed by the laws of India. Any disputes not resolved informally may be brought before the competent courts of Bangalore, Karnataka, India. Nothing in this clause limits Mulyra's ability to seek injunctive or other equitable relief in any jurisdiction, and nothing limits your rights under applicable Indian consumer protection or data protection legislation, including the Digital Personal Data Protection Act 2023.
Mulyra is not an employer, recruiter, or recruitment agency. Job listings published on Mulyra are not offers of employment under the Indian Contract Act 1872, the Industrial Disputes Act 1947, or any applicable state Shops and Establishments Act. Nothing on Mulyra creates an employment relationship or implies any representation regarding a user's eligibility for any particular position.
14.8 Class action waiver
TO THE EXTENT PERMITTED BY APPLICABLE LAW, YOU AND AEVORA LABS LLC AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE ACTION. This waiver does not apply where prohibited by law (including EU, UK, and Indian consumer protection law).
14.9 Australian users
For users located in Australia, this agreement is governed by the laws of New South Wales, Australia. Disputes shall be resolved in the courts of New South Wales. Nothing in this agreement limits any rights you may have under the Australian Consumer Law.
